INFORMATION ABOUT THE CREATION SCIENCE PAPERS

Papers created by plaintiffs' attorneys during the Arkansas Civil Liberties Union's successful challenge of that state's creation science law (Act 501 of 1981) were transferred to Special Collections by Mr. Stephen A. Smith of the Department of Communications, University of Arkansas, Fayetteville, February 3, 1986.  Mr. Smith received the papers from their creator, Mr. Robert E. Cearley, Jr., of Little Rock, Arkansas.

In 1981, the Arkansas State General Assembly enacted a law requiring "equal time" for the public school teaching of evolution and "creation-science" (a specific interpretation of the Genesis account of creation held by some members of the evangelical fundamentalist sect of Christianity).  The Arkansas Civil Liberties Union immediately challenged the law, and retained the Little Rock law firm of Cearley, Gitchel, Mitchell and Bryant to represent the plaintiffs.  Principal attorney for the plaintiffs was Mr. Robert E. Cearley, Jr.  These papers were created by Mr. Cearley and his staff during preparation for the case.

The material consists of legal documents, correspondence, notes, and research files.

Series 1.  Witness and Deponent Files (Boxes 1-14)
 
Depositions, resumes, and research materials relating to witnesses and deponents in the case.  The series is divided into two subseries:

Subseries 1. for individuals called at the behest of the defense, and
Subseries 2. for individuals called by the plaintiffs.

As these papers were created by the attorneys for the plaintiffs, papers concerning witnesses and deponents called by the defense are incomplete.

For the most part, these are "discovery" as opposed to "evidentiary" depositions, taken in order to "discover" the testimony of opposition witnesses.  Discovery depositions are seldom entered into the record, but are available to be introduced if needed.  No "protective order"--a legal restriction on their access--was entered in to the record; the depositions and resumes are therefore part of the public record and available to researchers.

Series 2.  Court Papers (Boxes 15-16)

Documents filed with the court as a formal part of the legal proceedings. These papers include affidavits, stipulations, briefs, orders, requests, motions, and other legal documents.  The order imposed upon the documents by the plaintiffs' attorneys has been maintained; that is, a number was assigned to each document according to the date on which it was entered into the record.  The first folder of this series contains a master index of the court papers.

Series 3.  Exhibits (Boxes 17-21)

 This series is divided into two subseries.  Subseries 1. contains the plaintiffs' attorneys' copies of exhibits filed with the court.  These are predominantly exhibits entered by the plaintiffs, although a few defendants' exhibits are included in Box 17, folder 1.

The arrangement imposed upon these exhibits by the court has been retained.  The court assigned a number to the exhibits according to the order in which they were introduced into the record.  Box 17, folder 2 contains the three plaintiffs' exhibits submissions, i.e., the formal list of exhibit
titles submitted to the court.  This serves as an index to the exhibit numbers.  Plaintiffs' exhibits 1, 2, 28-33, and 118-129 are missing, although their titles are included in the exhibits submissions lists in Box 17, folder 2.

Subseries 2. contains exhibits separated by the plaintiffs' attorneys and entitled by them "Religious Exhibits."  The order imposed by the donors has been retained:  the exhibits were assigned an arbitrary number and arranged according to that number.  Box 21, folder 1 contains a master index of the religious exhibits.  Exhibit 4 is missing.

Series 4.  Background Readings (Boxes 22-27)

This series consists of reading material collected by the plaintiffs' attorneys on issues critical to the case, and used by them in their research efforts.  Readings were divided by the plaintiffs' attorneys into broad topical categories which include critiques of creationism, the history of science, science issues, scientific literature, the scientific method, and other topics.

Series 6.  Published Materials (Boxes 33-36)
 
This series contains books and pamphlets gathered by the attorneys for the plaintiffs during research for the case.  The materials are composed predominantly of items created by creationist organizations for use in schools.  As many of the items are part of a series, they are arranged alphabetically by title.

Many of the items will have following the title a number/letter combination, such as "7s" or "6t."  While it is not certain, this is believed to refer to the school grade level for which the book or pamphlet was intended.  Identical titles with differing number/letter suffixes will be designated "Same, (number/letter suffix)."
